From subjects to suspects: the deprivation of liberty of black teenagers

This article examines the deprivation of liberty of adolescents accused of committing offenses. Although the Statute of Children and Adolescents (ECA) restricts the application of socio-educational measures for this population, deprivation of liberty is understood here as a continuous process that begins at birth and manifests itself through successive forms of non-realization of rights, such as education, health, and leisure, especially for Black and poor children and adolescents. The text begins with a theoretical and documentary review that relates the Brazilian legacy of slavery to the Marxist concept of material freedom, referencing the territory of Rio de Janeiro. It concludes that this path of exclusion finds its legal state in incarceration and culminates, ultimately, in the extermination of Black youth, which intensifies in the context of the "war on drugs" policy.
