The dilemma of open-pit metal mining in Panama regarding “Minera Panamá”: between the sustainability of life and the exploitation of nature

This article analyzes the sociopolitical crisis in Panama caused by the approval of Law 406 and its implications for the contract with Minera Panamá, S.A. Throughout 2023, the controversy generated by the lack of transparency and citizen participation in decision-making prompted massive social mobilizations, highlighting the involvement of social movements, unions, and youth activists demanding environmental protection and national sovereignty. The government’s response was the repeal of the law and a historic ruling by the Supreme Court declaring the mining contract unconstitutional, based on violations of fundamental rights and constitutional articles that protect natural resources and social well-being. We outline the various positions that emerge from the tumultuous reality provoked by open-pit metallic mining extractivism in Panama.
