Expropriation of rights and the protagonism of judicial power: notes on present times

O processo histórico de consolidação da cidadania se confunde com o amadurecimento e desenvolvimento do capitalismo. A constituição de um aparato protecionista denominado Welfare State assegurou, pelo menos nos anos gloriosos do capitalismo, uma vivência efetiva dos direitos e, consequentemente, a consolidação da cidadania. No entanto, o agravamento da crise capitalista fez com que este sistema desmoronasse, processo vivenciado desde os anos 1970 em nível mundial e no Brasil, a partir dos anos 1990. Neste sentido, o Poder Judiciário sai de sua aparente apatia e passa a assumir um papel de protagonista frente a defesa dos direitos sociais, determinando o cumprimento de suas decisões pelo Executivo e Legislativo. Buscando discutir estes elementos, o presente artigo tem como objetivo discutir a expropriação de direitos na contemporaneidade e o papel protagonista assumido pelo Judiciário. Conclui-se, portanto, que frente a impossibilidade de assegurar a cidadania historicamente conquistada, o Judiciário exerce seu protagonismo na defesa dos direitos sociais.
