A monitoração eletrônica de presos no regime aberto e a inclusão no mercado de trabalho

O artigo apresenta uma discussão sobre as questões do processo de Monitoramento Eletrônico de presos introduzidos no ordenamento jurídico brasileiro a partir da edição das leis 12.258 de 2010 e 12.403 de 2011 e seus efeitos no processo de inclusão social pelo trabalho dos egressos do Sistema Prisional. Tal estudo problematiza os entraves e desafios dessa inclusão a partir de uma análise teórica e empírica da realidade Mineira, expondo os direitos previstos na Lei de Execução Penal, Constituição Federal e no Direito do Trabalho. Além disso, procura verificar alguns efeitos da exclusão social de egressos do sistema prisional, permeados pela a punição na modernidade, os objetivos da pena e os direitos garantidos aos egressos do sistema prisional. O artigo também aborda o lugar do trabalho na vida das pessoas condenadas a pena privativa e seus desafios no contexto da Monitoração. Fatores estes que se apresentados no contexto capitalista e globalizado interagem com a lógica de uma sociedade pautada em novas tecnologias de controle penal.
