Dossier: The 200 years of the liberal Constitution of 1822 in Portugal: transitions and discontinuities of constitutionalism and liberalism in the Luso-Brazilian space in the 19th century
The dossier "The 200 years of the liberal Constitution of 1822 in Portugal: transitions and discontinuities of constitutionalism and liberalism in the Luso-Brazilian space in the 19th century" proposes to reflect on issues of political and constitutional history in Portugal and Brazil from the experience of constitutional monarchies that took place throughout the nineteenth century in both countries. The opportunity for these studies is the milestone of 200 years of the 1st modern Constitution in Portugal. The proposed dossier aims to analyze the paths of constitutionalism and liberalism in Portugal and in the Brazil in a century marked by effervescence having as reference for analysis the categories of political history and public law between Portugal and Brazil. However, it is important to bear in mind that the dynamics of apparent discontinuities do not elude the task of identifying, describing and understanding the continuities and transitions from constitutionalism and liberalism in the nineteenth century, as well as the similarities and idiosyncrasies as either in Portugal, in relation to other European countries, or in the newly independent Brazil, in which the influences and disputes sometimes come closer to the old metropolis, sometimes distance themselves with distinct traits. In each of them, however, there was in common the banner of changes based on freedom, publicity in opposition to the secrecy of the absolutist and centralist monarchy, and the equality before the law. It is necessary to define whether the liberal and constitutionalist movements rendered specific contours adapted to the factual reality and specific circumstances in each hemisphere, and whether it is possible to speak of various liberalisms with their own dynamics.
