continuities and ruptures in Brazilian educational legislation for music education

This article aims at reflecting on the laws that govern the teaching of Arts, specifically Music, in Brazilian schools in a historical perspective. For this, we will go back to LDBEN 4.024/61, looking through Law 5.692/71 to reach LDBEN 9.394/96 and the present day, pointing out the continuities and the ruptures that cause the subject to be in a constant struggle for space within the school context. The theoretical-methodological framework is based especially on the study by Tyack and Cuban (1995) about the impact of educational reforms proposed by the public authorities on society and schools, in addition to extensive bibliographical and documentary research. Currently, educational legislation comes up with proposals which suggest big news. Reforms are implemented by governments as magical solutions to educational problems, when, in fact, they repeat even more distortedly the principles of past and failed reforms.
